SURROGACY Legal Steps as per New Law in India

Hi Friends who need SURROGACY

Presently the process of surrogacy is made too cumbersome like the Couple need to approach their Native District ART&SURROGACY Board with medical history and obtain an approval of medical indication from them

Then choose a Surrogate (which, fertility centres are barred from providing like in past) who's ready to help without taking any compensation in cash or kind but out of Love, carrying your Baby till Term accepting only Medical expenses & other prescribed expenses, as the law says

Have to take same Boards approval for her too, who shd be Married and have a healthy Baby of own, alongwith her husband to sign consent

Once these two approvals got, all of you need to file a Joint Affidavit before your local judicial first class magistrate in the format attached to the Act & Rules and have "Parental Order" issued

Then, you can choose any registered surrogacy clinic in India & get the procedure of IVF and embryo transfer done

Thereafter if result is positive ok or you can try for two more times on her and not more than that... otherwise need to choose another woman fit for it.

You need to take 36Months Insurance Policy in her name for a Suitable Amount like 5Lakh

Then once positive you need to provide medical care to her and get the delivery done, thereon report to the same court and obtain the Birth Certificate of your Baby

Any couple aged more than 50 wife & 55 husband or having a Baby already own/adopted aren't eligible to avail surrogacy in India

NO USE of DONOR GAMETES (Egg & Sperm) as it's is banned by New Law for any age couple So choose a good centre to help you on this, who's sure good Results.

So we are unable to help you find a Surrogate. like we used to do in the past and keep them in a Care Home with us till Delivery which actually is a wonderful arrangement in all regards. But unless Law changes we can't do anything

This seems ridiculous & Cumbersome but the system is made by the government and there's No other way left.
